Acuerdo con el afiliado
Condiciones para el Afiliado de Tradedoubler dentro de la Plataforma privada de Aon

La aceptación de estas condiciones son inherentes al comienzo del uso de la Plataforma privada de Aon en Tradedoubler.

En caso de usar imágenes corporativas o la marca de Aon para generar contenido del afiliado, será imprescindible y obligatorio seguir las normas corporativas de uso de la misma, además de tener que contar con la aprobación previa de la persona de contacto de Aon.
  1. Logo en los formatos disponibles y normas de su uso:
 
  • Logo original (rojo): sobre fondo de color blanco, o navy y escala de grises que aparecen en la paleta que también adjunto
  • Logo en blanco: sobre fondo rojo y resto de fondos de color
  • Logo en negro: sobre fondo blanco preferiblemente cuando las condiciones de impresión lo obliguen
  • No se pueden modificar los colores del logo más allá de esas opciones ni utilizarlo de una forma no descrita anteriormente.

2.1. Colores corporativos. En caso de utilizar la marca y/o logo así como otro contenido de Aon, será obligatorio atenerse a los colores corporativos de la misma:




En ningún caso, jamás se permitirá al Afiliado hablar en nombre de la marca y, en todo caso, siempre debe redirigir a los clientes a los puntos de contacto oficiales para cada uno de los productos.
  1. Responsabilidad sobre el mal uso de la plataforma o de la marca


En el supuesto de que el afiliado incumpliera con las directrices de uso de marca y mensaje indicadas por el Anunciante (AON), se informa al Afiliado que se le excluirá de manera inmediata del programa de afiliación de AON, sin que ello suponga ningún tipo de responsabilidad para AON como anunciante.  Las cantidades adeudadas se abonarán en la liquidación correspondiente, si es que quedaran cantidades pendientes de abonar por parte de AON.

AON se reserva el derecho a realizar cuantas acciones legales interese para la reparación de los posibles daños ocasionados por el incumplimiento de las directrices indicadas en el programa de afiliación pudiendo indemnizar a AON ante cualquier obligación, procedimiento, coste, pago, daño, pérdida o gasto que AON pudiera incurrir como consecuencia del incumplimiento de las normas de publicación o de marca.
  1. Cláusulas de corrupción de Aon

A. GARANTÍAS Y MANIFESTACIONES DEL COLABORADOR
 
Cumplimiento de la legislación y de la Política de Prevención del Fraude de Aon (Aon Anti-Bribery Policy).

1.    En la ejecución del Contrato, el Colaborador cumplirá con todas las leyes —incluyendo las referidas a la prevención del fraude y normativa anticorrupción—, y requisitos administrativos aplicables y no llevará a cabo actuación alguna que pudiera implicar el incumplimiento por AON IBERIA de las citadas leyes, normas o requisitos administrativos aplicables.

2. El Colaborador no pagará, ofrecerá, entregará o realizará promesa de pago, directa o indirectamente, ni autorizará el pago de todo o parte de la retribución recibida en virtud del Contrato, ni cualquier otra cantidad o cosa de valor en favor de:

  1. funcionarios o empleados de cualquier Administración estatal, autonómica o local, incluyendo entidades o sociedades públicas o participadas por cualquier Administración;
  2. empleados o funcionarios de una organización internacional pública;
  3. ninguna persona que actúe en sus funciones públicas en nombre o interés de cualquier Administración estatal, autonómica o local u organización internacional pública;
  4. ningún partido político o representante o afiliado del mismo;
  5. ningún candidato a puesto político;
  6. ningún empleado, apoderado, directivo o accionista de cualquier cliente de AON IBERIA; o
  7. ninguna otra persona física o entidad en base a la recomendación, petición o dirección de ninguna de las personas o entidades descritas con anterioridad o en beneficio de las mismas.

3. El Colaborador garantiza conocer las disposiciones de las leyes aplicables, incluso penales, y las leyes contra el blanqueo de capitales de España, y la Política de Prevención del Fraude de Aon (Aon Anti-Bribery Policy). En relación a las obligaciones para con AON IBERIA en virtud del Contrato, el Colaborador no incurrirá en acciones u omisiones en contravención de estas disposiciones o de la Política de Prevención del Fraude de Aon (Aon Anti-Bribery Policy). El Colaborador garantiza que ha recibido y leído (i) una copia del Código de Conducta Aon y de la Política de Prevención del Fraude de Aon (Aon Anti-Bribery Policy), (ii) el documento “Anti-Corruption Training for Aon’s Business Partners”, y (iii) el documento “Socios de Cumplimiento. Política Anticorrupción para Terceros”, y se compromete a dar cumplimiento a dichos documentos.

El Colaborador realizará sus funciones con estricto cumplimiento de las normas relativas a la prevención del blanqueo de capitales, en particular de las disposiciones recogidas en Ley 10/2010, de 28 de abril, de prevención del blanqueo de capitales y de la financiación del terrorismo, y demás legislación aplicable o la que, en su caso, la sustituya. El Colaborador deberá informar a AON IBERIA inmediatamente de cualquier incidencia u operación sospechosa de acuerdo a la citada normativa.

4.    El Colaborador garantiza que no coadyuvará con ningún trabajador, directivos u otros representantes de AON IBERIA en ningún acto u omisión que pudiera violar la Política de Prevención del Fraude de Aon (Aon Anti-Bribery Policy), o las leyes aplicables, y si el Colaborador tuviere conocimiento de cualquiera de dichos actos u omisiones, deberá notificar inmediatamente a AON IBERIA tal circunstancia.

5.    Ni el Colaborador ni ninguno de sus representantes o trabajadores es, a la fecha de firma del Contrato, empleado o funcionario de ninguna Administración estatal, autonómica o local, o de una organización internacional pública, o de un partido político, o candidato a un puesto político.

6. Con efecto desde la fecha del Contrato y durante el transcurso del mismo, ningún empleado o funcionario de la Administración estatal, autonómica o local, o de una organización internacional pública, o de un partido político, o candidato a puesto político, tiene ningún interés, se encontrará vinculado, poseerá o posee en la actualidad tal interés, sea éste directo o indirecto, en el Colaborador o tiene o tendrá ningún interés o participación en este Contrato o en la retribución a satisfacer por AON IBERIA al Colaborador en virtud del mismo.

7. Adicionalmente a las estipulaciones 5 y 6 anteriores, el Colaborador garantiza que si cualquiera de dichas personas (tal como se definen en dichas estipulaciones) tuviera una participación o interés en el Colaborador o en el Contrato, el Colaborador lo notificará a AON IBERIA inmediatamente para que AON IBERIA pueda tomar (reservándose el derecho de hacerlo) cualesquiera acciones que considere adecuadas con el fin de asegurar el cumplimiento por AON IBERIA de todas las leyes, normas y requisitos administrativos aplicables.

8. El Colaborador garantiza que no ha pagado ni pagará, ni ofrecerá, directa o indirectamente, ninguna comisión o acuerdo comercial o retribución de intermediación a ninguna persona o entidad en relación a sus actividades derivadas del Contrato suscrito con AON IBERIA.

9. Respecto de las obligaciones del Colaborador derivadas del Contrato, éste manifiesta que no ha realizado y no realizará, ofrecerá o se comprometerá a realizar, ya sea directa o indirectamente, ninguna donación de carácter político.

10.  El Grupo Aon dispone de una estricta política global relativa al cumplimiento de las sanciones y restricciones comerciales internacionales (“Política SC”), incluyendo, en EEUU, aquéllas que competen a (o derivan de) la ‘Office of Foreign Assets Control (OFAC)’. El cumplimiento de la Política SC es obligatorio para todo el personal de Aon en todo el mundo, sin que se permita ninguna excepción bajo ninguna circunstancia. A modo de resumen, la Política SC se refiere a transacciones relativas a (o que tengan algún tipo de conexión con) Cuba, Irán, Birmania, Corea del Norte, Sudán, Siria, o cualquier otro país que pudiese ser objeto de sanción y/o restricción comercial, así como a ciertas personas objeto de restricción de conformidad con las legislaciones de EEUU, Reino Unido, y/o la lista de ‘Ciudadanos Especialmente Designados (SDN)’ de la OFAC.
       En caso de que algún miembro de Aon llegue a ser conocedor de que una colocación (ya realizada, o a realizar) pueda infringir, aun potencialmente, la Política SC, las directrices de la OFAC, o cualquier legislación aplicable en cualquier país en relación a restricciones/sanciones comerciales, deberá paralizarla, y someter el caso concreto a estudio, con el objeto de asegurar el cumplimiento de las precitadas disposiciones. En cualquier caso, la forma específica de proceder dependerá del caso en cuestión.
       El Colaborador deberá ajustarse en todo momento a la precitada Política SC, absteniéndose de promover la captación de cualquier cliente que pueda contravenir la misma.

Cualificación

11. El Colaborador garantiza estar plenamente cualificado para realizar y ejecutar las actividades derivadas del Contrato y que, en la medida en que ello sea exigible por ley, norma o requisito administrativo, el Colaborador ha obtenido aquellas autorizaciones, o efectuado aquellas inscripciones, que sean necesarias o imprescindibles para la ejecución del Contrato de Colaborador.

B. MODO DE PAGO Y APROBACIÓN DE GASTOS

12. Todos los pagos efectuados por AON IBERIA al Colaborador serán realizados únicamente tras el recibo de una factura debidamente emitida, exclusivamente por cheque o transferencia bancaria a una cuenta bancaria a nombre del Colaborador en el país donde los servicios van a ser prestados o donde el Colaborador ha establecido o mantiene su principal centro de actividad.

13. Los gastos de viajes, entretenimiento u otros relacionados con el desarrollo de este Contrato soportados por el Colaborador no serán reembolsados por AON IBERIA salvo que hayan sido aprobados por ésta con anterioridad por escrito, y sólo si se ajustan a la Política de Prevención del Fraude de Aon (Aon Anti-Bribery Policy).

C. LIBROS Y REGISTROS PRECISOS Y DERECHOS DE AUDITORÍA

14.  AON IBERIA podrá realizar en la medida de lo razonable, por sí misma o por medio de sus Representantes, auditorías al objeto de confirmar que ninguno de los pagos realizados en virtud de este Contrato será utilizado o efectuado, directa o indirectamente, o ha sido utilizado o efectuado, en contravención de la Política de Prevención del Fraude de Aon (Aon Anti-Bribery Policy) o de la legislación aplicable.

15. El Colaborador guardará libros y registros adecuados y precisos que reflejen todos y cada uno de los pagos realizados y los gastos incurridos en relación al cumplimiento del Contrato de Colaborador, y permitirá a los Representantes debidamente autorizados de AON IBERIA inspeccionar y realizar copias de dichos libros y registros, tras preaviso razonable.


D. INDEMNIZACIÓN

16. La retribución devengada por el Colaborador en virtud del presente Contrato no será satisfecha, o de haberse satisfecho ya, será reembolsada a AON IBERIA por el Colaborador si, a juicio razonable de AON IBERIA:

  1. cualquier ley —incluyendo las referidas a la prevención del fraude y normativa anticorrupción—, o requisito administrativo aplicable prohibiese o impidiese el pago de la retribución derivada de este Contrato; o
  2. el Colaborador hubiera incurrido en el incumplimiento de cualquiera de las garantías establecidas en el Apartado A del presente documento.

17. El Colaborador indemnizará y mantendrá indemne a AON IBERIA, sus trabajadores, clientes, y representantes en relación a cualquier reclamación dirigida contra AON IBERIA o sus trabajadores, clientes, y representantes, con fundamento en cualquier responsabilidad derivada de cualquier incumplimiento por parte del Colaborador de cualquiera de las garantías establecidas en el Apartado A del presente documento, o en cualesquiera actos indebidos negligentes o intencionales por parte del Colaborador que tengan lugar durante la vigencia de este Contrato. Dicha responsabilidad incluirá, sin limitación, daños y perjuicios, costes, y gastos.

E. CERTIFICACIONES

18. Cada año durante la vigencia de este contrato, y tras dos años desde su finalización, AON IBERIA, a su exclusiva y razonable discreción, podrá requerir al Colaborador para que emita certificaciones en relación a este Contrato, a sus declaraciones o garantías, y a las actuaciones del Colaborador en relación a AON IBERIA. El incumplimiento de emitir dichas certificaciones o la consignación de declaraciones falsas en la certificación, serán causas de finalización del Contrato, y habilitarán a AON IBERIA a ejercitar las cláusulas de finalización e indemnización del Contrato.

El Afiliado acepta de manera expresa el contenido de los dos documentos adjuntos en este anexo y sus enlaces para poder colaborar como Afiliado con AON dentro de Tradedoubler. Igualmente, con la aceptación de las condiciones el afilado confirma la recepción, lectura y conocimiento de los documentos de formación, uso y estilo que se adjuntan aquí abajo.

This Agreement is made the day set out below by and between
  • Tradedoubler UK Ltd hereinafter referred to as "Tradedoubler" and
  • You or "the Publisher"
WHEREAS
Tradedoubler has developed and operates a service which allows You to earn money by placing a link on Your website to the Company websites, connected to Tradedoubler.
In order to receive payments for your work as Private Network Publisher, You must accept the conditions of this Agreement and become authorized as a Publisher in the Tradedoubler network. Please read this Agreement carefully. By clicking on the Register button You accept the conditions of this Agreement. You will not receive commission payments if you do not accept the provisions of this Agreement.
You must be accepted by Tradedoubler and the Company to whose Private Network Program You would like to be registered to, before you can become a Publisher. You will be informed by the Company if and when You have been accepted as a Publisher.
This Agreement is limited to Publisher participation in the Private Network Program as described in section 1 below.

Now therefore, You hereto agree to the following bindings terms of the agreement. </p>  <ol>  <li><strong></strong><strong>Definitions</strong><br />  The following terms when used in this Agreement shall have the following meanings:
Linked Website- means a Website to which the Publisher has placed a link on his website and which is connected to the Private Network Program registered at Tradedoubler.
Visitor- means any person who clicks on a link placed on the Publisher''s website and thereby is connected to a Linked Website.
Click- means a click by a Visitor on a link on the Publisher''s website serving a Linked Website to the Visitor''s browser.
Lead - means a Visitor who is connected to a Linked Website by the Publisher and who has completed a definite act at the Linked Website, for example made a registration as a user.
Transaction/sale- means a Visitor who is connected to a Linked Website by the Publisher and who has completed an agreement to buy a product, service or anything else supplied on the Linked Website.
Traffic- is a collective term for valid Clicks, Leads and Transactions/sales.
Artificial Traffic- is a collective term for invalid Clicks, Leads and Transactions, which may originate (for example and without limitation) from automatic openings, spiders, robots, requests in e-mail or chat rooms, script generators, placing links on other websites than informed and Clicks which are not generated by a browser, Clicks which are not preceded by an active act of a Visitor who wants to reach a certain website.
Private Network Program- is the AON program owned and operated by Tradedoubler for the Company on Tradedoubler''s website which the Publisher can join, subject to Tradedoubler and Company acceptance as described herein.
Company shall mean %NAME_OF_SPONSOR
Words denoting the masculine gender include the feminine and other genders and words denoting the singular number only shall include the plural and vice versa.

The Service
The Publisher is allowed to place links on his website to the website which have the Private Network Program registered at Tradedoubler
Information about the Private Network Program will be available from the Company. The Publisher must keep himself informed of any amendments of the Private Network Program, The Publisher must comply with the requirements of the Private Network Program including in particular any stipulations as to the nature and content of the Publisher''s website and the use of third party or other Publishers trade marks and logos.
Tradedoubler reserves the right to modify, amend, change or terminate Tradedoubler''s payment service. The Publisher will be notified of all such changes by e-mail or by an announcement by the Company. If the Publisher does not accept the changes, the Publisher will not be paid.

Obligations of the Publisher
The Publisher is solely responsible for his website and its contents and shall ensure that they conform at all times to all applicable laws and regulations.
If the Publisher is a natural person he must be at least 18 years of age. If the Publisher has not reached the age of 18 a parent must give his consent to the registration to Tradedoubler''s service and the registration of a Publisher below the age of 18 without parental consent will be ineffective.
The Publisher warrants that the information furnished to Tradedoubler about himself and his website is correct, complete and sent in due order and that the information corresponds to actual facts. The Publisher must notify Tradedoubler immediately of any changes in the information by updating the information about him on Tradedoubler''s website. If the Publisher is a limited company Tradedoubler must be provided with the Publisher''s full registered name, company registration number, registered office, trading address if different and VAT number if registered.
The Publisher warrants either that the rights to all information and productions on the Publisher''s website belong to the Publisher or that the owner of the rights to the information and productions on the Publisher''s website has given his explicit permission to their publication there. The Publisher also warrants that the information and productions on the Publisher''s website do not infringe any rights of third parties, including intellectual property rights, and that such information and productions are not offensive, prohibited or questionable in any way.
The Publisher must not in any way generate or contribute to generating Artificial Traffic to Linked Websites.
The Publisher must notify the Company immediately of any known or suspected improper or wrongful use of the Publisher''s links to the Company’s website and/or the Private Network Program or of Tradedoubler''s service in any way whatsoever.

Obligations of Tradedoubler
Tradedoubler undertakes to execute payments to Private Network Publishers in accordance with this agreement only after having been paid by the Company.

Remuneration
The conditions of remuneration for the Private Network Program are agreed upon between the Publisher and the Company. The Publisher agrees to "self-billing", which means that Tradedoubler will create the invoice on behalf of the Publisher VAT (if applicable) is added to the remuneration shown on the Company’s Private Network Program interface.
Subject to clause 5.3, payment of accumulated remuneration to the Publisher shall be made monthly in arrears provided that the Publisher has generated valid Traffic and that Tradedoubler has received timely payment from the Company.
Payment of remuneration will be made, if prior to the payment date, the Publisher is due an amount of at least 50 € and if Tradedoubler has received full payment for these transactions. An amount due of less than 50€  will be accumulated to the next payment and will be included in the amount to be paid out at the next payment date, again provided that the minimum amount of at least 50€  is due prior to that payment date. All payments are calculated upon the total Traffic generated up to the end of the month prior of payment. Accumulated amounts do not accrue any interest.
Nothing in this Agreement shall create or be deemed to create, a partnership or relationship of employer and employee between Tradedoubler and the Publisher
Payment to the Publisher will be made direct to the Publisher''s bank account. The Publisher must specify on the Company Private Network interface details of his bank account (including name and branch of the bank, sort code of the branch and the Publisher''s account number).
The Publisher is responsible for the payment of all tax and national insurance payable on any payments made to him by Tradedoubler.

Limits on Tradedoubler''s Liability
Tradedoubler shall not be liable for costs and damages incurred by the Publisher arising out of this Agreement unless caused directly by the negligence of Tradedoubler in providing its service. Tradedoubler shall not in any circumstances be liable for indirect or consequential damages and costs incurred by the Publisher for any reason whatsoever.
Tradedoubler will not be liable for defects in the service, interruptions in the accessibility to the service, infringements on data or loss of data on the information handling system, defects in the security system or viruses or other harmful software components in Tradedoubler''s service or for any damage caused by viruses or components to the service, the Publisher’s software and/or the Publisher''s website. Tradedoubler shall not be liable for any error in the implementation of the links on the Publisher''s website or for the specified function of the links.
Tradedoubler shall not be liable if the Company does not fulfill its obligations according to its Private Network Program and Tradedoubler shall not be liable in any way for any agreements made directly between the Publisher and the Company.
Term and Termination
This Agreement shall come into force upon Your acceptance as a Publisher and shall remain in effect until terminated.
The Publisher is entitled to terminate this Agreement with immediate effect at any time. The Publisher must cease to use the service immediately upon the termination of this Agreement and delete all links to Linked Websites.
If the agreement is terminated by either party, Tradedoubler will pay any outstanding amount on the next following payment date.
Tradedoubler is entitled to terminate this Agreement and/or suspend the Publisher from Tradedoubler''s service or from the Private Network Program if:

Tradedoubler considers the Publisher or the content of his website inappropriate in any way.
Tradedoubler is requested to do so, for any reason, by the Company.
The Publisher acts fraudulently or illegally in any way or the Publisher generates or tries to generate Artificial Traffic to Linked Websites or the Publisher in any other way breaches any of the provisions of this Agreement.

Upon suspension of the Publisher from the Private Network Program, the Publisher shall immediately delete all links to the Company''s or other relevant website/s. </li>  <li> Upon termination of this Agreement, Tradedoubler shall inform the Publisher immediately through the Company’s Private Network interface, and the Publisher shall immediately cease to use the service and delete all links to Linked Websites.
This Agreement expires immediately on termination and no remuneration will be paid to the Publisher for the Private Network Program if the Publisher is suspended for the reasons stated in 7.4.3

Indemnity

The Publisher shall keep Tradedoubler indemnified against any claims for damages or other claims for compensation arising from the contents of the Publisher''s website or any incorrect information given to Tradedoubler by the Publisher. The Publisher shall also compensate Tradedoubler for any other damages or costs caused by the Publisher''s improper, negligent or unauthorised use of Tradedoubler''s service and technical problems or loss of data caused by the Publisher on Tradedoubler''s website or on any website to which the Publisher is linked by Tradedoubler.
Assignment of the Agreement

The Publisher may not assign or pledge his rights or obligations under this Agreement in whole or in part to any third party without the prior written consent of Tradedoubler. The Publisher agrees that Tradedoubler may assign its rights and obligations under this Agreement and divulge or transfer information about the Publisher''s website, e-mail etc to any third party.
Consent
The Publisher consents to the publication of the Publisher''s name and web address etc at Tradedoubler''s website.
Severability
If any provision of this Agreement or part thereof should to any extent be or become invalid or unenforceable, the parties shall agree upon any necessary amendment of the Agreement in order to achieve the interests and objectives of the parties prevailing at the time of execution of the Agreement.

Intellectual Property Rights
Tradedoubler owns all copyrights, trademarks, intellectual property rights, know-how or any other rights connected to the service or software necessary for the service. The Publisher does not acquire any rights or licenses whatsoever under this Agreement other than to use links to Linked Websites on the terms of this Agreement.
Applicable Law
Tradedoubler shall not be liable for the legality of Tradedoubler''s service in countries other than the %COUNTRY. The Publisher is solely responsible for the legality of the use of the service if the Publisher is registered to Tradedoubler''s service from a country other than %COUNTRY or if the Publisher''s website is on a server in a country other than %COUNTRY.
This Agreement shall be governed by, and construed in accordance with the laws of %COUNTRY, excluding its choice of law provisions and is subject to the exclusive jurisdiction of the %COUNTRY courts.

The integrity of individuals is an important factor of Tradedoubler's business success. Tradedoubler's advertisers, publishers, media agencies and other customers (hereafter the "Client/Clients") that from time to time provide Tradedoubler with personal data, as well as web surfers whose digital data is processed by Tradedoubler as part of its provision of services to its Clients (hereafter the "User/Users"), must be able to trust that data is processed by Tradedoubler in accordance with applicable privacy laws and regulations.
This Privacy Policy was created in order for Clients and Users to better understand how information relating to them is processed by Tradedoubler. The Privacy Policy is not exhaustive, but contains certain fundamental privacy principles applied by Tradedoubler which Tradedoubler considers to be of particular importance for Clients and Users to be aware of. If you do not agree to this Privacy Policy and/or other terms and conditions stated in connection with the collection, please do not provide personal data to Tradedoubler. Tradedoubler reserves the rights not to provide you certain products or services should you choose not to provide required personal data.
Part 1 of the Privacy Policy contains Tradedoubler's general privacy principles with regard to its processing of personal data provided by Clients, Users or other individuals.
Part 2 of the Privacy Policy contains information regarding Tradedoubler's processing of digital information about Users. It also contains requirements on publishers with whom we have contracted to serve  marketing services, to notify Users about Tradedoubler's services on their websites and obtain User´s consent when required by applicable laws.
Part 3 of the Privacy Policy contains contact information for different kinds of inquiries and requests relating to Tradedoubler's processing of data and this Privacy Policy.
Tradedoubler may at any time and without notice change the Privacy Policy, e.g. to keep it compliant with applicable laws. You should therefore read this Privacy Policy each time you intend to provide Tradedoubler with personal data.
Part 1 - General privacy principles
Personal data and controller of personal data
Personal data comprises all information that directly or indirectly can be referred to a natural person who is alive, e.g. name, postal address, e-mail address and phone number. A controller of personal data is the natural or legal person who processes personal data and who decides why and how such data shall be processed.
Tradedoubler AB is the controller of personal data provided by you through the website 'www.Tradedoubler.com='. Tradedoubler AB is the Controller of personal data provided to us by you through sub-sites of www.Tradedoubler.com, that are published and maintained by Tradedoubler AB or its subsidiaries (all Tradedoubler websites hereafter referred to as the "Site") unless otherwise indicated when such data is collected, or personal data that you are asked to provide us with in other situations.
Collection of personal data
Personal data for which Tradedoubler is controller may be provided by you to us e.g. in the following situations:
·If you are a Client you may be required to provide us with personal and corporate information, such as name, address, email address and other account information, in order to be able to access and use our services;
·As part of our sales efforts, we may collect and store data through online forms for contact purposes;
·If you are a prospect Client, you may provide us with personal data through this Site when applying to join our network;
·You may provide us with personal data when you send us inquiries relating to our services or in relation to this Privacy Policy. The collection of personal data is based on legitimate interest according to the above and for the performance of a contract to which you and Tradedoubler are the parties.
Use of personal data
Tradedoubler is committed to protect any personal data you provide to us and to process your personal data in accordance with this Privacy Policy and applicable laws.
Personal data provided to Tradedoubler may be used for the following purposes; provide you requested products and services; manage Tradedoubler's agreed obligations and rights towards you; process payments; administration; internal analysis to improve or more effectively tailor Tradedoubler's Site, business or offerings generally; allow you access to agreed products and services; direct marketing; any other purpose you have consented to or which is allowed under applicable law. Your personal data may also be processed for additional purposes stated on any relevant part of the Site or otherwise in connection with the provision to us of your personal data. Your personal data may be combined with other information collected from you or third parties for the above purposes.
 
Disclosure and transfer of personal data
Personal data may be transferred to other companies within the Tradedoubler group of companies. Tradedoubler may as a consequence of service agreements with third parties, also transfer personal data to such third parties who process personal data on behalf of Tradedoubler. Such service agreement shall contain obligations for third parties to process data only in accordance with Tradedoubler's instructions and to take appropriate measures to secure that the processing of the personal data is secure.
For any of the purposes described herein, personal data may be transferred to Tradedoubler's business partners within or outside the EU/EEA. Should any of the recipients reside in a country without adequate legal protection for personal data, Tradedoubler will make reasonable efforts to make the recipient adopt the principles described in this Privacy Policy and if necessary, make a Transfer Impact Assessment prior to any transfer to a country outside EU/EEA.
Consent
Where it is required by law or where Tradedoubler otherwise deems it appropriate, Tradedoubler will seek consent from you before Tradedoubler processes your personal data. Such consent may e.g. be obtained by asking you to accept processing of your personal data in accordance with this Privacy Policy. If you do not agree to this Privacy Policy and/or other terms and conditions stated in connection with the collection, please do not provide personal data to Tradedoubler. Tradedoubler reserves the rights not to provide you certain products or services should you choose not to provide required personal data.
Withdrawal of consent
You are at all times entitled to withdraw your consent to process personal data if you have provided consent to Tradedoubler. In such case Tradedoubler will not process your personal data based on consent any more.
You are entitled to request that Tradedoubler shall not process your personal data for direct marketing purposes.

Right to information and rectification of personal data
Tradedoubler will take reasonable measures to rectify incorrect information, block or erase personal data without undue delay. You also have the right to contact Tradedoubler in order to object the processing or use the right to data portability.  Part 3 of this Privacy Policy contains information about who you should contact if you would like us to correct personal data that we hold on you and which you consider incorrect.
To the extent required by law, we will inform you about Tradedoubler's processing of your personal data in connection with the initial collection or registration of your personal data. Such information may e.g. be provided by notifying you about this Privacy Policy.
You may request a copy of the personal data that Tradedoubler holds about you ("Subject Access Request"). This information will include information regarding what personal data Tradedoubler processes about you, where such information has been collected, for which purpose the information is being processed, and to whom, or to which categories of persons, the information is being disclosed. Destruction of personal data
Any personal data that we hold on you is only stored as long as it is required for us to keep them in order to fulfill the purposes for which they were collected. Data may however be necessary to store for a longer period due to legal requirements, e.g. for accountancy purposes.
Security
Tradedoubler is dedicated to maintain the security of personal data and preventing unauthorized access through the implementation of appropriate technical and organizational measures, as far as is reasonably possible. Such security measures also include that personal data may be accessed only by a limited number of persons within Tradedoubler.
Our employees are made aware of and must comply with Tradedoubler's security standards. When we occasionally use third-party contractors to perform tasks that might otherwise be performed by our employees, these contractors are contractually bound to adhere to this Privacy Policy and they are subject to similar restrictions as our employees.
Cookies
The Site contains cookies. This Site sends your browser a cookie - a small piece of data stored on your computer's hard drive. The purpose of the cookie is to improve your reading of and your search possibilities on our Site. If you are a registered Client (e.g. a publisher), the cookie will also manage and control your login and session on those part of our Site that are only available to registered Clients.

Part 2 -  Tradedoubler's processing of digital information about Users
Introduction
Tradedoubler processes digital information about Users (web surfers) who visit websites belonging to Clients with whom Tradedoubler has contracted to serve advertisements (the "Advertising Network"). This part of the Privacy Policy lets you know what information we collect and process about you as a User on behalf of our Clients, why we collect it and how it is used in relation to our services to our Clients. The Policy contains instructions on how you can display and delete information collected by Tradedoubler yourself.. Further, the Policy contains instructions to our publishers on how to notify Users about Tradedoubler's services on their websites.
The fundamental integrity principle underlying all Tradedoubler's processing of digital data relating to Users, is that such data shall be anonymous. Therefore, we do not store IP addresses on the cookie of a User, only a unique randomly generated ID that does not allow Tradedoubler to identify the User; we do not have, and will not initiate, any co-operation with Internet Service Providers in order to identify Users. The data stored on the cookie is limited to information collected at the User's visits to websites belonging to Tradedoubler's Advertising Network.

Privacy

Tradedoubler does not save any personal information in the cookie and cannot identify the information in the cookie to a specific person.


Opt-out
Note that you are always able to prevent cookies from any website from being installed on your computer by readjusting your browser settings. For more information about cookies and how to disable them, you should consult the help section of your browser.
Publisher notification
If you are a publisher, please note that you are obligated to notify visitors of your website about third parties who are serving advertisements on your website by way of use of cookies. If using Tradedoubler’s cross-device tracking solution, you are required to notify visitors to your website of this fact, gain their consent for passing data to Tradedoubler and to hash the data in accordance with Tradeoubler´s instructions before sending it to Tradedoubler. The consent needs to be in line with GDPR and the ePrivacy directive . As a party to the publisher agreement with Tradedoubler, you agree to provide clear and unambiguous notice about this.
To comply with the regulations governing cookies under the GDPR and the ePrivacy Directive you must:
  Receive users’ consent before you use any cookies except strictly necessary cookies.
  Provide accurate and specific information about the data each cookie tracks and its purpose in plain language before consent is received.
  Document and store consent received from users.
  Allow users to access your service even if they refuse to allow the use of certain cookies.
  Make it as easy for users to withdraw their consent as it was for them to give their consent in the first place.
For avoidance of doubt, please note that the foregoing requirement of notification and gaining visitors´consent does not limit any of your obligations according to applicable law. You are yourself as a publisher responsible for providing relevant and accurate information required by law, including applicable privacy laws.
